Case Summary:
In this bungee cord lawsuit, the plaintiff adduced evidence of a long history of known failures of the hooks of the bungee cord at issue. These hooks, made in China, were reportedly of inadequate tensile strength to withstand the loads and forces to which the bungee cords would be subjected in foreseeable use.
As the plaintiff was securing a ladder to the top of his truck with a bungee cord manufactured by Bungee International and purchased by the plaintiff at Home Depot, one of the j-shaped hooks deformed and sprang back into the plaintiff's eye. The plaintiff produced evidence showing that the manufacturer had actual knowledge of the deficiency of these hooks, yet had taken no corrective action whatsoever to rectify their structural deficiency, other than adding a warning label tag to the bungee cords.
The case settled at mediation for $900,000
