Case Summary:The plaintiff alleged that he was caused to slip and fall down a flight of stairs in a McDonald's restaurant after an employee mopped the stairs and failed to post any warning signs or caution cones to alert patrons that the stairs were wet. As a result of the plaintiff's fall down the stairs, he suffered multiple traumatic injuries, including a herniated disc at L4-5; a rotator cuff tear; a cerebral concussion; and a bruised kidney. All of these injuries resolved except for the ruptured disc.
The plaintiff had been a heavy equipment operator, and notwithstanding efforts to retrain him, the plaintiff's physician and other doctors opined that the plaintiff was not a surgical candidate, and was totally and permanently disabled. The plaintiff, 33, was earning more than $40,000 per year. One month prior to the running of the statute of limitations, when suit was about to be filed, the insurer agreed to pay $1.5 million cash to the plaintiff and his wife.
