Premises Liability: Burns
Amount: $525,000
Case Summary: Contractor/Premises liability case against a plumber and contractor of house where a 2-year-old girl was scalded in a bathroom sink after being given a bath by her 4-year-old sister, unbeknownst to their parents who were in an adjoinng room. Lawsuits were filed against the plumber and contractor who installed the plumbing/heating system in the house as well as the plumbing/heating service company which maintained the heating system. Liability arose as a result of the failure to install a tempering valve into the system which would have mixed cold water with hot and thereby avoided scalding hot water coming from the tap.
